Terms of Use

1. Purpose of Pulse

Pulse notably allows users to browse and discover dance events, organizer profiles, venues and related information.

Some features are available without an account. Others require an account to be created.

Pulse may notably allow users to save events, manage an agenda, follow profiles, use discovery preferences or report certain content.

A standard user does not have a public profile and cannot publish content, comment or send messages to other users.

2. Use Without an Account

Some Pulse features can be used without creating an account.

In that case, certain preferences, favorites, follows or agenda information may be stored only on the user's device.

This local data may be lost, notably if the application data is cleared, the application is uninstalled, the device is reset or the user changes device.

Certain features, notably reporting content or accessing organizer features, require an account.

3. Account Creation and Security

Creating a Pulse account currently requires an email address and password, as well as confirmation of the email address.

The user must provide an email address they can actually access and must keep their authentication credentials confidential.

The user is responsible for the use of their account and must inform Pulse if they become aware of unauthorized use or a security issue.

Pulse may change authentication or security mechanisms where necessary for the operation of the service.

4. Minors and Legal Capacity

Pulse does not currently request users' age or date of birth.

Anyone using Pulse must do so within the limits of their legal capacity and the rules applicable to them.

Where authorization or the involvement of a legal representative is required by law, the user concerned is responsible for obtaining it.

In particular, requesting organizer access requires the applicant to be able to legitimately represent the activity or organization they indicate.

5. Organizer Access

Features allowing users to create and manage organizer profiles or publish events are not automatically available to all users.

Organizer access is subject to a request and approval by Pulse. A request may be accepted, refused or, depending on the situation, subject to restrictions.

When submitting the request, the user certifies that they represent the activity or organization indicated and expressly accepts these Terms of Use as well as the Publishing and Moderation Rules.

Approval of organizer access by Pulse does not constitute certification of the activity, the quality of services, professional qualifications or all information provided by the organizer.

Organizer access may notably be revoked in the event of impersonation, a confirmed dispute, abusive use or failure to comply with these Terms or the publishing rules.

6. Publishing by Organizers

Organizers may notably publish profiles, events, descriptions, images, logos, prices, schedules, venues, links and registration information.

The organizer is responsible for the information and content they publish.

They must ensure that it is accurate and kept up to date and must not publish information they know to be false, misleading or likely to mislead users.

Pulse performs certain technical validations, notably regarding completeness of data, dates, certain links, prices or publishing constraints, but does not systematically verify the material reality of each event or piece of information published.

Published content must also comply with Pulse's Publishing and Moderation Rules.

7. Role of Pulse and Organizer Responsibility

Pulse primarily provides a discovery and information service.

Events presented in the application are organized under the responsibility of the organizers who publish them.

In the current version of the service, Pulse:

• does not materially organize these events;
• does not sell tickets for them;
• does not collect payments related to participation in them;
• does not manage refunds for them;
• does not guarantee access to an event.

Participation terms, prices, cancellations, refunds, venue rules and other terms specific to an event therefore fall under the responsibility of the organizer or relevant service provider.

Pulse cannot guarantee the permanent accuracy, quality, physical safety or availability of an event published by a third party.

This provision does not limit any liability that legally rests with Pulse for its own acts or obligations.

8. External Links and Services

Pulse may contain or open links to websites, social networks, registration services, ticketing services, maps or other services operated by third parties.

The presence of a link does not mean that Pulse operates or guarantees the service concerned.

Users are encouraged to review the terms and policies applicable to the third-party service before using it.

Pulse technically validates certain link formats but does not systematically control their content or availability.

9. Geolocation, Mapping and Calendar

Certain features may use the device's location when the user authorizes it.

This use is optional.

Maps, addresses, coordinates and directions may depend on third-party services, and no absolute accuracy of location or mapping is guaranteed.

Pulse may also allow a copy of an event to be added to an Android calendar with the user's permission.

This copy is not automatically synchronized with subsequent changes made in Pulse. The user must therefore check updated event information in the application or with the organizer.

10. Pulse Pro and Promotions

Pulse may offer different levels of access or features reserved for organizers, notably under the name Pulse Pro.

Pulse Pro may notably provide access to additional quotas or features, as well as certain event promotion options.

As of the date of these Terms, no paid Pulse Pro subscription, in-app purchase or paid event promotion is offered in the application.

If paid features are offered in the future, the applicable pricing, billing, renewal and, where applicable, refund terms will be communicated before purchase, and these Terms may be updated.

11. Ownership of Organizer Content

The organizer retains their rights to the texts, images, logos and other content they publish in Pulse.

They warrant that they hold the rights and authorizations necessary for their use and publication.

To enable Pulse to operate, the organizer grants Pulse a non-exclusive, royalty-free authorization, limited to the needs of the service, allowing Pulse notably:

• to store and host the content;
• to technically reproduce it;
• to display it across the various screens of the service;
• to distribute it to Pulse users;
• to perform necessary technical adaptations, notably image compression, resizing or cropping.

This authorization does not transfer ownership of the content to Pulse.

It applies for the period necessary to make the content available, subject to any retention justified by moderation, security, legal obligations or the defense of rights.

12. Pulse Intellectual Property

Unless otherwise stated, elements specific to Pulse, notably its visual identity, interface, design, editorial texts, logo, organization and protected software elements, may not be reused beyond what is necessary for normal use of the service without prior authorization.

Making Pulse available does not transfer any ownership rights in the service to the user.

13. Prohibited Conduct

Pulse may not be used for any illegal or fraudulent purpose or in a manner that infringes the rights of others.

It is also prohibited, in particular:

• to attempt to access without authorization an account, feature, database or protected part of the service;
• to deliberately bypass access controls or security measures;
• to intentionally disrupt the operation of the service;
• to knowingly exploit a vulnerability in order to harm the service or its users;
• to engage in spam or abusive automation;
• to carry out large-scale collection or scraping that harms the operation of Pulse, users' rights or applicable rules;
• to use the reporting system in a manifestly abusive manner;
• to publish content prohibited by the Publishing and Moderation Rules.

The prohibitions above do not prevent acts expressly authorized by law.

14. Moderation

Public organizer profiles and events may be reported by signed-in users.

Moderation decisions are made by humans, and a report does not automatically result in content being removed.

Depending on the situation, Pulse may notably request a correction, hide or remove an event, suspend a profile or account, or revoke organizer access.

15. Suspension and Revocation of Access

Pulse may apply a moderation measure where justified by the operation of the service, user safety, these Terms or the publishing rules.

Depending on the situation, measures may separately concern:

• content;
• an event;
• an organizer profile;
• organizer access;
• an account.

A suspension does not necessarily result in the immediate deletion of associated data or the technical deactivation of authentication itself.

Revocation of organizer access does not automatically delete associated profiles, events or other content.

16. Account Deletion

The user may request deletion of their account from the application or from the Pulse website.

The procedure currently requires password verification as well as confirmation by email.

Deletion results in the removal of the main data associated with the account, subject to information that may be retained for the reasons described in the Privacy Policy, notably certain moderation histories or elements necessary for security and the defense of rights.

Signing out of the application does not constitute deletion of the account.

17. Service Availability and Changes

Pulse may evolve over time.

Certain features may be added, modified, suspended or removed, notably for maintenance, security, compliance, technical development or service improvement reasons.

Pulse does not guarantee permanent or uninterrupted availability of the service.

The user may also need a compatible device, Internet connection or system permissions for certain features.

18. Liability

Each party remains responsible for the obligations imposed on it by law.

Pulse cannot be held liable for a failure directly attributable to an organizer or third-party service, notably regarding the material organization of an event, its cancellation, conduct, price or the performance of a service provided by that third party.

Pulse also cannot guarantee that the service will be free from all errors, interruptions or unavailability.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

19. Changes to These Terms

These Terms may be amended notably to take into account:

• changes to Pulse;
• new features;
• legal or regulatory changes;
• changes affecting users' rights or obligations.

The date of the latest update appears at the top of this page.

Where a significant change justifies it, Pulse may inform users through a method appropriate to the operation of the service.

The new Terms apply from their effective date, subject to any mandatory rules that apply.

20. Applicable Law

These Terms are governed by French law, subject to any mandatory provisions that may apply to the user, notably where they benefit from specific protections as a consumer.

In the event of a difficulty, the user is encouraged to contact Pulse in order to seek an amicable solution.

Failing that, the competent courts are determined in accordance with applicable law.
